Bankruptcy

Bankruptcy isn’t the end - it’s a new beginning. When your debt becomes unmanageable with little hope of being able to pay it back, bankruptcy may be the answer.

We at Charla Smith & Company understand the impact bankruptcy can have on you, and will only recommend it if it’s truly the best option. We prepare the paperwork, deal with the government and the creditors, and help you through the process from start to finish. During that time, we help you plan for and regain a sense of hope about, your financial future.

With our kind approach, we are here to help you make a fresh start.

Reclaim Control of Your Finances

Civilized society decided long ago that when an honest individual's debt becomes so overwhelming they have no realistic hope of repaying it, there needs to be a way to obtain relief from that debt. Bankruptcy provides that relief with a fresh start, allowing you to regain financial control and continue your life without being weighed down by debt.

Bankruptcy is a legal process, featuring a 'stay of proceedings' that will stop creditors from calling and prevents them from pursuing any legal action. To file bankruptcy in Canada requires you to have lived or done business in Canada over the past year, owe a minimum of $1,000 (though typically debt is much higher), and not have the means to pay it all back.

Charla Smith & Company offers a welcoming, non-judgemental approach to dealing with your debt. We understand that debt happens. We are available to meet with you to answer any questions and help you decide if bankruptcy is the best solution for you, or if there are other options that make more sense.

FREQUENTLY ASKED QUESTIONS

Not likely. Here in Alberta, there are laws that exempt certain assets from seizure by your creditors, and that includes bankruptcy. Depending on your situation, you may not lose any assets at all - many don't. For more information, check out our blog post entitled: What I Wish People Understood About Bankruptcy | Do you lose all of your assets in bankruptcy?

We would be happy to set up a meeting to discuss the extent to which your assets may or may not be exempt in bankruptcy.

Typically the only impact on your spouse occurs if they have co-signed any of your debt. In that case, if you are not able to pay the debt your spouse may become fully responsible for it. Often, people bring their spouse along to our consultation meetings, in which case we are able to discuss their situation as well, and the impact your options might have on them.

Often no one finds out unless you tell them. Most bankruptcies do not have to be advertised in the newspaper and, while any bankruptcy filing goes on the public record, someone would have to search for it (and pay a fee) to find that record.
